The defendant pays a percentage of the total bail amount (in California typically it is 10%) to the bail bond company, who in turn guarantees the defendant will go to all their court dates or risks being “liable” to pay the full bail amount to the court if the defendant is not found with in 1 year of the bond forfeiture date. If the defendant fails to appear in court, the bail bond agent is responsible for returning the defendant back to court. The defendant is ultimately liable for the full bail amount if he is not found and brought to court. If not found the bail bond company pays the full bail amount to the court.

What it is is simple. To obtain a bail bond in California, a defendant must first be granted bail by a judge if the case and charges are serious or violent; otherwise, the defendant can simply go off of the county bail schedule based on the predefined Penal Code. Every penal code has a set bail amount in the “Bail Schedule Book.” Once bail is set, the defendant or their representative can contact a bail bond agent. The bail bondsman will typically require the defendant, friends, or family to pay or to provide collateral and a co-signer in order to secure the bond. Once the bond is secured, the bail agent will pay the full bail amount to the court, and the defendant will be released from jail shortly after it is paid.

The defendant must then meet certain conditions set forth by the court and bail bond company, such as attending all court hearings and not committing any further crimes. If the defendant fails to meet these conditions, the bail bond may be revoked, and the defendant may be returned back to jail. Additionally, if the defendant fails to appear in court or violates any of the “Conditions of Bail,” set by both the judge and the bail bondsman, The bail bond agent may hire a bounty hunter to locate and apprehend the defendant. This is why it is important for the defendant to comply with all of the conditions of their bail and appear in court as scheduled. 


If the defendant appears in court as scheduled, the bail bond will be exonerated (dissolved), and if there is collateral, it will be returned ONLY to the person who provided it and signed over the collateral. The bail bond agent will keep the premium paid by the defendant or their family for paying the bail amount in the form of a bond and posting service.
